SkyMapper, Inc. (“SkyMapper”, “we”, “us” or “our”) respects your privacy and is committed to being transparent about our privacy practices. This Privacy Policy describes the types of information we may collect from you when you visit our website at www.skymapper.io, any subdomain thereof, or any related mobile or desktop applications, including any content or functionality offered on or through any of the foregoing (collectively, the “Site”), or when you make any purchase through the Site. This Privacy Policy also describes our practices for collecting, using, maintaining, protecting, and disclosing such information.

This Privacy Policy applies to information we collect on the Site or through your access or use of the same, and in any email, text, or other electronic messages between you and the Site. Except as otherwise expressly set forth herein, it does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party, nor to information collected by any other third party, including through any application or content (including advertising) that may link to or be accessible from or on the Site.

Please read this Privacy Policy carefully before you start to use the Site to understand our policies and practices regarding how we treat your information. By accessing or using the Site in any manner, including, without limitation, by making any purchase through the Site, you accept and agree to be bound by this Privacy Policy. If you do not agree with any terms of this Privacy Policy, you may not access or use the Site for any purpose.

This Privacy Policy may change from time to time (see Changes to this Privacy Policy, below). Your continued use of the Site after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Site, where you live, and as permitted or required by applicable law:

  • Contact details including your name, address, billing address, shipping address, phone number, and email address.

  • Financial information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details.

  • Account information including your username, password, security questions, preferences and settings.

  • Transaction information including the items you view, put in your cart, add to your wish list, or purchase, return, exchange or cancel and your past transactions.

  • Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.

  • Device information including information about your device, telescope, browser, or network connection, your IP address, and other unique identifiers.

  • Geolocational data, which may be automatically collected when you navigate through the Site.

  • Usage information including information regarding your interaction with the Site, including search queries through the Site, and information on how and when you interact with or navigate the Site.

Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you including when you create an account, visit or use the Site, communicate with us, or otherwise provide us with your personal information;

  • Automatically through the Site including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;

  • From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;

  • From our partners or other third parties.

How We Use Your Personal Information

Depending on how you interact with us and the Site, we may use personal information for the following purposes:

  • Provide, Tailor, and Improve the Site. We use your personal information to provide you with the Site, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Site.

  • Provide Products and Services. We use your personal information to provide you with those products and services you may order through the Site. Where you elect to participate in the SkyMapper Network, we may also use your personal information to make the SkyMapper Network and its functionality available to you.

  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Site or other websites, including based on items you previously have purchased or added to your cart and other activity on the Site.

  • Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Site and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.

  • Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.

  • Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.

  • Other Purposes. We use your personal information for such other purposes as may be incidental to normal use of the Site, and for any other purpose for which you provide your consent.

How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).

  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites.   • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.

  • With our affiliates or otherwise within our corporate group.

  • To comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Site, our rights, and the rights of our users or others.

We also reserve the right to transfer your personal and other information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets.  Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your information in a manner that is consistent with our Privacy Policy.

Relationship with Shopify

The Site is hosted by Shopify, which collects and processes personal information about your access to and use of the Site in order to provide and improve your experience with the Site. Information you submit to the Site will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Site for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Site, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. Third Party Websites and Links

The Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Site and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Site.

Children's Data

The Site is not intended for or directed to children. No one under age 16 may provide any information to or on the Site. We do not knowingly collect or solicit personal information from children under age 16. If you are younger than 16 years of age, do not use or provide any information on the Site or any of its features or otherwise provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under age 16, we will delete that information. Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Site, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

Your Rights and Choices

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Cookies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Site may then be inaccessible or not function properly.

Emails. SkyMapper may send service updates, service notifications, promotional information (including, without limitation, SkyMapper newsletters) and other communications to you via email. Promotional email communications will contain instructions describing how you can opt out of receiving future promotional emails from us. You may also email us at thom@skymapper.io to be removed from our mailing list. If you opt out of promotional emails, you may continue to receive non-promotional, transactional emails from us.

Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an email with your request to thom@skymapper.io. 

Limiting Provided Information. You can choose not to provide us with certain information. If you decline to provide certain information, however, please note that some features of the Site may then be inaccessible.

Accessing, Correcting, and Retaining Your Information

You may send us an email at thom@skymapper.io to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We retain personal information that we collect for as long as we need to use it in connection with our business and in accordance with our standard practices or in compliance with applicable laws. When we no longer need the personal information, we will deidentify, aggregate, or delete this information where required by law.

Your State Privacy Rights

California Residents. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by email at thom@skymapper.io or write to us at the mailing address set forth at the end of this Policy.

Colorado, Connecticut, Virginia, and Utah Residents. Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to: (i) confirm whether we process their personal information; (ii) access and delete certain personal information; (iii) data portability; and (iv) opt-out of personal data processing for targeted advertising and sales. Additionally, Colorado, Connecticut, and Virginia also provide their state residents with rights to: (v) correct inaccuracies in their personal information, taking into account the information’s nature and processing purpose; and (vi) opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects. Nevada Residents. Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out right may submit a request in writing to us by email at thom@skymapper.io or to the mailing address set forth at the end of this Policy. However, please know that we do not currently sell data triggering that statute’s opt out requirements.

Your European and UK Privacy Rights

If you are a resident of the European Union or the UK, you are entitled to certain information and have certain rights under the General Data Protection Regulation (Regulation (EU) 2016/679) (the “GDPR”) or the UK GDPR adopted post Brexit (also referred to herein for convenience as simply the “GDPR”). Those rights include:

  • the right of access to your information.

  • the right to rectify your information if it is incorrect or incomplete.

  • the right to have your information erased (“right to be forgotten”) if certain grounds are met.

  • the right to withdraw your consent to our processing of your information at any time (if our processing is based on consent).

  • the right to object to our processing of your information (if processing is based on legitimate interests).

  • the right to object to our processing of your information for direct marketing purposes.

  • the right to receive your information from us in a structured, commonly used and machine-readable format, and the right to transmit your information to another controller without hindrance from us (data portability).

If you are located in the European Union or the UK and you are or have been a user of our services (or a purchaser of our products), we may send you marketing communications based on our legitimate interests, subject always to your right to opt out of such communications. Further, if you are located in the European Union, we will never share your information with a third party for such third party’s marketing purposes, unless you have specifically consented to us doing so.

You may contact us at thom@skymapper.io to exercise any of the above rights. We may request specific information from you to confirm your identity, and in some circumstances, we may charge a reasonable fee for access to your information.

Furthermore, if you believe that our processing of your information is inconsistent with your data protection rights under the GDPR and we have not adequately addressed your concerns, you have the right to lodge a complaint with the data protection supervisory authority of your country.

For purposes of the GDPR, we are a “controller” and you are a “data subject.”

“Do Not Track” Requests

Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. The Site is not currently set up to respond to those signals.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. International Transfers

Please note that we may transfer, store and process your personal information outside the country you live in.

If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law.
